CLEARCORRECT COUPON TERMS AND CONDITIONS

CLEARCORRECT COUPON TERMS AND CONDITIONS
These terms and conditions (Terms) govern the use of the ClearCorrect Coupon (Coupon), as they may be varied from time to time. No other terms are implied by trade, custom, practice or course of dealing, unless otherwise detailed in these Terms. In these Terms, when we refer to ‘we’, ‘us’ or ‘our’, we mean Straumann (as defined in clause 1 below). When we refer to ‘you’ or ‘your’ we mean the user and purchaser of the Coupon.
1. Information about us
The Coupon is issued and managed by Straumann Limited (company number 02646013) (Straumann), which is a company registered in England and Wales and our registered office is at 10 Finsbury Square, London, EC2A 1AF. We operate the website https://www.straumann.com/clearcorrect/gb/en/patients.html.
2. Allocation of Coupons 
2.1 We will confirm our acceptance of your Coupon order to you by sending you an email. The contract between you and us will only be formed when your Coupon order has been placed and the Coupon appears in your ‘Dr Portal’.
3. Using the Coupon
3.1 The Coupon may be redeemed via the ‘Doctor’ portal on our ClearCorrect website [https://dr.clearcorrect.com/authentication], when purchasing directly from us.
3.2 Our order process allows you to check and amend any errors before confirming your order to us, however we will not be responsible to you for any issues caused by any such errors. Please check the order carefully before confirming it. You are responsible for ensuring that your order is complete and accurate.
3.3 The Coupon may only be used for discount towards ‘ClearCorrect’ cases.
3.4 The Coupon cannot be redeemed against:
3.4.1 treatment set up for FLEX cases or Retainers
3.4.2 any other product, or service
3.4.3 any outstanding invoices you may have with Straumann (or any member of the Straumann group of companies); or
3.5 Only 1 Coupon can be used per Case, and the Coupon may not be used in conjunction with any other offer or promotion.
3.6 When redeeming the Coupon to purchase a Case, such purchase will be subject to Straumann’s general terms and conditions, which can be found here.
4. validity of the Coupon
4.1 The Coupon is valid for a 3-month period from the date of an onboarding appointment with a member of our team.
4.2 After expiry, Coupons will be forfeited. We will not provide you with any notice that the Coupon is due to expire and the Coupon validity period is not extendable.
4.3 The Coupon may not be exchanged for cash or credit, is not a credit card nor is linked to a deposit account.
4.4 The Coupon may not be resold, exchanged or transferred to another customer, account, provider or any other third party and we may suspend the Coupon where attempts are made to do so.
5.  Data protection
5.1 We will use any personal information you provide to us to:
5.1.1 Provide the Coupon;
5.1.2 Inform you about similar products that we provide, but you may stop receiving these at any time.
5.2 We will process your personal information in accordance with our privacy policy: https://www.straumann.com/group/en/discover/privacy/gb/en.html as updated from time to time.
6.  Limitation of liability
6.1 Nothing in these Terms excludes or limits our liability for:
6.1.1 death or personal injury caused by our negligence;
6.2 fraud or fraudulent misrepresentation; and
6.3 any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
6.4 Subject to clauses 7.1 and 7.3, our maximum, liability to you in respect of your use of a Coupon shall be limited to the balance available on your Coupon.
6.5 We are not responsible for any loss or damage that is not foreseeable.
7. Termination
7.1 If you breach any of these Terms, we may (without prejudice to any right or remedy we might have at law):
7.1.1 temporarily or permanently withdraw your Coupon;
7.1.2 refuse to allow a Coupon to be redeemed against the purchase of a Case; and/or
7.1.3 take further legal action against you.
8. Governing law and jurisdiction
The Contract is governed by English law, and you and we each irrevocably agree to submit all disputes arising out of or in connection with the Contract to the exclusive jurisdiction of the English courts.
Straumann reserves the right to amend these Terms from time to time, where we consider it reasonable and necessary to do so.
